General

L'extravagance is a sole proprietorship that organizes festive Sunday brunches monthly in different places in Geneva and its surroundings.

These general conditions, which L'extravagance reserves the right to modify at any time, apply, without restriction or reservation, to ticket sales for festive brunches in general, to the conditions of access and to any use of the services. offered by L'extravagance, in particular through its website for the secure purchase of tickets online.

These general conditions apply to the exclusion of all others. They are accessible at any time on the L'extravagance website, and will prevail, if necessary, over any other version or any other contradictory document. 

Anyone who purchases a ticket for L'extravagance confirms that they have read and accepted these terms and conditions which thus form part of each ticket for L'extravagance sold.  

It is specified that under the terms of these general conditions, the term “ticket” applies to all access titles in any form whatsoever (ticket, package, subscription and invitation). 

1 Ticket office 

1.1 Acquisition of a ticket: 

Extravagance strives to provide buyers with quality professional service.  

It uses proven technology for this purpose, in particular with regard to printable tickets and tickets presented on mobile phones and it calls on professionals and qualified suppliers or partners by providing all the required diligence. That being said, L’extravagance can in no way guarantee an irreproachable and uninterrupted supply of services related to the sale of tickets, nor exclude intrusions into computer systems or misuse by third parties. The extravagance thus declines all responsibility for damages that may result from such circumstances. Liability for third-party services in connection with ticket sales is excluded. 

Buyers and users of the L'extravagance website are assumed to be familiar with the means of electronic communication (website and mobile) and to be aware of the data security risks associated with their use. Users undertake to make only legally acceptable use of these electronic means. The L'extravagance website is understood as the official site supplemented by any other IT platform used by L'extravagance to carry out its online ticketing. These general provisions also cover the activities of IT service providers that L'extravagance may use. 

L'extravagance declines all responsibility, within the limits of legal provisions, for any damage that may occur on the computer system of the ticket buyer or any third party, which would be linked to the use of the website.

 

1.2 Tickets: 

The buyer acknowledges that the purchase of tickets offered by the Extravagance on its website, gives rise to rights and obligations between him and the organizer. 

The contract for the purchase of a ticket is based on these general conditions as well as the general conditions of the ticketing partner if applicable, the first prevailing. By purchasing a ticket, the purchaser accepts the provisions regarding security, access and additional regulations relating to the event in question. In addition, the buyer is aware of the fact that in the event that these regulations are not respected, he will be refused access to the event without compensation. 

Tickets to attend the extravagance festive brunches can be purchased on the extravagance website and on site at its cash desk. Any ticket purchased by any other means may be refused by L'extravagance. 

Ticket prices are in Swiss Francs, VAT included (if applicable and according to the rates in force). 

The various prices and free entrance fees are explained on the information materials of the ticket office, in particular on the internet pages of L'extravagance relating to ticketing elements. 

Tickets are issued to the buyer only in the event that payment has been authenticated and validated. This authentication and this validation are the sole responsibility of the credit organization used by the buyer or, respectively, of the body to which the organization has given a mandate for these checks. 

1.3 Creation of customer account: 

The said customer account is personal to each buyer who can only create one. The buyer must ensure that the personal data provided is complete and corresponds to reality.  

The buyer will take all the usual precautions to prevent the disclosure of his password or misuse or use by unauthorized third parties. 

The buyer is responsible for notifying L'extravagance as soon as possible if he observes or suspects an abusive or unauthorized use of his account. 

The extravagance is not liable, within the limits of the legal provisions, for damage caused by misuse or by unauthorized third parties.

1.4 Ticket control, fraud protection: 

The extravagance checks the validity of the ticket at the entrance to the event by electronic means, in particular using the QR code. A control of the legitimacy of the ticket holder remains reserved. 

The name of the ticket purchaser or holder appears on the ticket. The buyer must ensure that the data entered is accurate and corresponds to reality. A ticket is reserved for the use of a single person, for a single passage. The purchaser of the ticket will be held responsible in the event of multiple use of his ticket. As such, he is responsible for keeping his ticket(s) in a safe place, in order to avoid any theft, falsification or indelicate copying.  

In the event of theft, loss or doubt, the buyer agrees to contact L'extravagance as soon as possible (excluding the day of the event). The latter will thus be able to cancel his ticket and send him a new entry ticket. This service may, if necessary, be invoiced to him. 

L'extravagance cannot be held responsible in the event that the printing of a new ticket due to the above circumstances is not carried out in time. 

Copying, reselling, modifying or tampering with tickets is prohibited. Falsified, resold, fraudulently acquired or copied tickets (resulting in the seizure of the competent authorities) are not valid. The Extravagance reserves the right to refuse all tickets from this purchaser, including non-counterfeit tickets.  

The organizer may refuse entry to a spectator when several printings, reproductions, copies or imitations of a printable ticket are in circulation and access to the event has already been granted beforehand to the holder of a printing, a reproduction, copy or imitation of the corresponding printable ticket. In particular, the organizer is not obliged to verify the identity of the person presenting the printable ticket in order to verify that it is indeed the ticket buyer, nor to verify the authenticity of the ticket. printable insofar as the imitation or copy cannot be identified beyond doubt as such when checking entry to the event. If the holder of a printable ticket is rejected for this reason during an access control, there is no right to a refund of the price paid. 

The ticket must be kept until the end of the event and presented on request.  

The ticket holder attends the event to which the ticket gives access under his own responsibility.

Any trade in tickets purchased for commercial purposes is prohibited. It may lead to the loss of rights and services related to the ticket, claims for damages and the restitution of profits earned. Buyers who violate this clause may be banned from purchasing tickets permanently. 

Resale of tickets is prohibited. Only tickets purchased on the L'extravagance website are valid.

1.5 Cancellation, Postponement and Refund: 

Reimbursement and return of extravagance tickets are in principle excluded.  

1.5.1 Program change: 

The extravagance program of events is systematically communicated via its various means of communication, also in the event of modification. Cancellations or program changes, even at the last minute, are always possible. These changes do not in any way give the right to a refund or exchange of tickets. 

In the event of definitive cancellation of an entire event, the reimbursement of tickets is a priori excluded. The extravagance nevertheless retains the right to decide to refund, exchange or not the tickets according to the context of the cancellation. The extravagance will proceed in this way provided there is sufficient financial cover to do so. 

Outdoor events take place in principle whatever the weather. Particularly unfavorable weather conditions do not give rise to a refund of the ticket. 

1.5.2 Force Majeure: 

In the event that L'extravagance is forced to cancel or postpone the event due to a case of Force Majeure or a cause that is not attributable to it, there is no right to reimbursement of the price. purchase of the ticket. 

By Force Majeure, it is understood any external and/or unforeseeable event, independent of the will and or the actions of the extravagance, which makes the holding of the event impossible, even particularly dangerous, for example: terrorist threat, public calamity , war, epidemic, pandemic, fire, flood, national strikes or restrictions, earthquake, extreme weather conditions. 

It is specified that in the event that the circumstances of Force Majeure have rendered the holding of the event financially or technically disproportionate, L'extravagance reserves the right to cancel or postpone the event, even if the said Force Majeure event had disappeared. before the start of the event but has made the preparation impossible or prevented the constructions necessary for the smooth running of the event. 

It should be noted that the obligations of L'extravagance will be suspended in the event of an event constituting a case of Force Majeure and the suspension of the obligations cannot in any case be a cause of liability for non-execution of the obligation in question, nor induce the payment of damages or late payment penalties. 

Report: 

In the event of a decision to postpone the event, the ticket is valid for the postponement date only. No ticket will be refunded in case of postponement. 

1.5.3 Refund decision: 

In the event of a refund decision by L'extravagance, the tickets concerned must be presented for refund by following the instructions which will be communicated on the L'extravagance website, within a maximum period of 30 days after the announcement of the cancellation. /refund. After this period, any refund is excluded.  

The extravagance reserves the right to deduct from the total net price of the ticket, any related costs. 

Provided that the deadline for requesting reimbursement set by L'extravagance has passed, any absence of a request for reimbursement will be equivalent to a donation by the Buyer to L'extravagance.

The acceptance of this clause is decisive in the conclusion of the contract. Also, the Ticket Purchaser knowingly declares that he wants to donate the amount paid for his ticket in the event that he has not submitted any request for reimbursement within the time limit set by L'extravagance (above). 

1.6 Stopping ticket sales: 

The extravagance can stop the sale of tickets at any time without having to justify the reason. 

2 Access to the event, behavior and safety 

2.1 Access: 

Entry to the event is subject to the presentation of a valid entry ticket in accordance with the requirements of number 1 above. 

The following rules apply for access to the site: 

Anyone under the age of 16 must be accompanied by an adult.  

It is forbidden to bring the following objects into the enclosure of the event, without this list being exhaustive, the decisions of the staff of the event being authentic as the case may be: 

-Pyrotechnic objects of all kinds, explosive, flammable or volatile substances, more generally, any object likely to serve as a projectile, 

-Weapons or objects assimilated to weapons, all sharp or blunt objects, 

-Drugs: Swiss legislation prohibits all trade, consumption and possession of narcotics.

It is forbidden to sell or distribute products of any kind within the event and its surroundings.

2.3 Conduct and Violations: 

The instructions of the organizers and their staff should be followed.

The ticket holder accepts the instructions of the general conditions and the measures (including health) that may be imposed by law. 

The ticket holder acknowledges that he may be escorted outside the event grounds, without compensation, if he does not comply with the requirements of these general conditions. Depending on the circumstances and at the sole discretion of L'extravagance, a permanent ban on entry may be ordered, without compensation. All rights in damages are reserved by L'extravagance.

A denunciation to the Authority by L'extravagance is reserved. 

A confiscation of material introduced or used contrary to these general conditions is possible by L'extravagance. A delivery of the equipment to the police is also reserved. 

3. Information 

The extravagance cannot offer any guarantee as to the completeness, topicality and accuracy of the information disseminated on these means of communication, nor exclude transmission errors. L'extravagance cannot be held responsible for any damages and actions that may result. The extravagance will however make every effort to ensure that the data and information published on its website are always exhaustive, recent and accurate. 

Users and ticket buyers acknowledge in particular that L'extravagance cannot give any guarantee as to the content published on third-party websites or means of communication.

 

4. Intellectual Property 

The entire content of the L'extravagance website is the property of L'extravagance and is protected by applicable intellectual property rights (copyright, etc.).  

Any total or partial reproduction of this content is strictly prohibited and may constitute an offense of counterfeiting. 

The extravagance remains the owner of all the intellectual property rights on the photographs, presentations, studies, drawings, models, prototypes, etc… carried out for the provision of the services offered. Their reproduction or exploitation is prohibited without the express, written and prior authorization of L'extravagance, which may also condition it to a financial consideration. 

Any downloading or copying of a page or part of the L'extravagance website may only be made for strictly personal use. 

5. Data protection 

The personal data provided by ticket buyers are only provided to allow the use of the services offered by L'extravagance. 

L'extravagance undertakes not to transfer to a third party the data concerning people making the electronic purchase of a ticket subject to the necessary communication of data to the ticketing partners of L'extravagance, for the proper functioning of the services provided. by the latter. 

All personal data will be kept confidential. Only the data necessary for the execution of the commercial process will be kept. 

The data protection law as well as the general data protection regulation is also applicable. 

In addition, the use of personal data is detailed in the Privacy Policy. 

6. Characteristics to communication networks 

Buyers and users of the L'extravagance website and other media are assumed to be familiar with the means of electronic communication (website and social networks) and to be aware of the data security risks associated with their use. 

They consider themselves fully informed of the risks inherent in the use of telecommunications networks. In this sense, it is recalled that the transmission of data by communication networks only benefits from relative technical reliability, in the sense that L'extravagance cannot be held liable in the event of: 

misappropriation of data, 

intrusion by unauthorized third parties on the services offered, 

computer offences, 

saturation of networks. 

The services offered by L'extravagance on its website or through its other media may be subject to interruptions, scheduled or not. Any unscheduled and non-faulty interruption cannot engage the responsibility of L'extravagance. 

Users undertake to make only legally acceptable use of these electronic means. The L'extravagance website is understood as the official site supplemented by any other IT platform used by L'extravagance to carry out its online ticketing.

7. Limitation of liability 

The extravagance excludes all liability for personal or material damage resulting from the organization of the event or its progress. 

In particular, the following limitations of liability apply: 

The program communicated by L'extravagance is subject to change. 

L'extravagance makes every effort to provide the best possible information to users of its website. However, it cannot absolutely guarantee the accuracy of the information presented, in terms of its accuracy, completeness and veracity. 

Extravagance is not liable for damage resulting from errors in telecommunications, technical problems, system failure or illegal manipulation of the computer systems involved, regardless of location and form of the alteration. In addition, any liability for damage caused by malfunctions, interruptions or overruns of the computer system is excluded. 

Extravagance is not liable for direct or indirect damage resulting from the services or information offered on its website, except in the event of gross negligence or fraud committed under its responsibility.  ;

Liability for damage caused by interconnection with other websites is also excluded. L'extravagance emphasizes that inconvenience may result from other websites unknown to L'extravagance and will not be liable for the content, products, services and other facilities provided by these sites.

Extravagance provides its services within the scope of its commercial and entrepreneurial resources as well as foreseeable requirements in a diligent manner.

8. Modifications, safeguard clause 

Extravagance reserves the right to adapt and modify its general conditions at any time. 

Changes to the general conditions are communicated in an appropriate manner, in particular by a corresponding publication on the website of L'extravagance. Regular consultation of these is therefore recommended. 

The possible invalidity or inapplicability of certain clauses of these general conditions does not affect the validity of the other clauses of these general conditions. 

9. Applicable law 

This contract is exclusively subject to Swiss law. The competent jurisdiction will be determined with regard to the domicile of L'extravagance.
